More often than not, an accident is not just an accident. Regrettably, some accidents result in loss of life because of another person’s negligent behavior or because of a company or corporation has been negligent. In Maryland, certain family members can bring a claim and hold the negligent party responsibility for the loss of life of their family member or loved one.

In Maryland, a Wrongful Death action may be filed, and money damages may be recovered by the surviving family members for their emotional pain and suffering resulting from the loss of life. The surviving family may also be compensated for the economic losses that may have resulted from the death of their family member of loved one.

If the person whose life was lost experienced conscious pain and suffering as a result of the negligent conduct of another, the deceased person’s Estate may assert a claim on behalf of the deceased person. This is called a Survival Action and it is filed at the same time as the Wrongful Death claim.
